Important Update on U.S. Government Requirements when using Airfreight to Move Goods

As of today, Monday 23rd September 2024, the United States Government (USG) have issued new requirements for airfreight travelling to or through the United States and originating in one of these designated countries. These requirements mandate that cargo may only be tendered from shippers with whom the forwarder has an existing account or 'Established Business Relationship' (EBR).
 
To comply with the new requirements, for all shipments departing on or after 23rd September 2024, the forwarder must confirm they have verified that all shipments meet the new EBR criteria as detailed below.
 
With each Master Air Waybill (MAWB), the forwarder must provide confirmation that it has verified that all shippers associated with the MAWB meet at least one of the following EBR criteria:

1. The shipper is a Known Consignor under the security program of a national authority 

2. The shipper has an account with the forwarder that was established prior to September 2, 2024, and contains at least one of the following:

  • The shipper's shipping and billing address and documented payment or credit history
  • Documented sales history, including any relevant contacts or activities
  • Other documented business correspondence or records

3. For shippers who became customers after September 2, 2024, the forwarder must have records of the following information:

  • A business or corporate registration certificate, licence or record
  • Business or corporate information, including name, address, phone and email
  • Contact information for an authorised point of contact for the account
  • Payment information (e.g. a corporate credit card)
  • A signed contract between the shipper and the forwarder

To meet these requirements, forwarders must submit, with the manifest documents at the time of acceptance, their confirmation via this Freight Forwarder Declaration form.

This means that when Mouse & Bear Solutions offer Importer of Record (IOR) services to the USA or Latin America (LATAM) that transit to or via the USA, we are unable to offer airfreight services since the shipper will not have an existing account or EBR set up directly with our freight forwarder or their nominated agent in the originating country. To comply with the new U.S. government requirements, the shipper must go through the process above with their forwarder.
