Exporting to Japan
Classification of Goods: Determine if your goods fall under the category of dual-use items. Dual-use goods are classified according to the Japan Foreign Exchange and Foreign Trade Act (FEFTA), and the Export Trade Control Order (ETCO). The ETCO provides a list of controlled items and their respective classification numbers.
Check Export Control Lists: Verify whether your goods are listed on Japan's Export Control List. This list includes specific items that require an export licence for transfer outside of Japan.
You can access the relevant control lists from two sources. The first is the Ministry of Economy, Trade, and Industry (METI). The second is the Japan Customs website.
Export Licence: If your goods are subject to export control, you must obtain an export licence from the METI. Submit an application, providing detailed information about the goods, their intended use, end-users, and end-use. The METI will review the application and grant an export licence if all requirements are met.
Compliance with International Regulations: Dual-use goods may also be subject to international export control regulations, such as those set by the Wassenaar Arrangement. Ensure that your goods comply with these regulations as well.
Importing to Japan
Import licences in Japan are generally not required for dual-use goods

Customs Procedures: Prepare all necessary import documentation, such as commercial invoices, packing lists, bills of lading, and the required permits.
Customs Declaration: File a customs declaration for your imported goods, providing accurate and detailed information about the items, their value, and classification. You will be required to declare any relevant export licences from the exporting country.
Reporting: After importing dual-use goods, you may need to provide post-import reports to the METI. These reports help track the flow of controlled items and ensure compliance with regulations. The specific reporting requirements will depend on the nature of the goods and their classification.
It is important to note that some major mass-market brands have IP Protection. As a result, these brands can only be imported by distributors that are authorised by the manufacturer.
